Damage, Insurance and Liability Policy

Policy version 13 August 2026 - Phase 1

This policy explains responsibility for item damage, loss, safety, qualifications, personal injury, and third-party property damage on MyJuhuu.

No MyJuhuu insurance is included. The refundable security deposit is payment security, not insurance. It does not guarantee payment of a claim and is not necessarily the maximum amount for which a user may be legally responsible.

1. Phase 1 insurance disclosure

MyJuhuu does not currently provide item insurance, renter liability insurance, owner liability insurance, personal accident insurance, or any other insurance for a booking. Users must not describe a booking, item, user, or claim as insured by MyJuhuu.

Owners and renters are responsible for checking whether their own personal, household, business, property, or liability policies cover paid peer-to-peer rentals, borrowed or rented items, commercial activity, and the relevant equipment.

2. Owner and renter responsibilities

Owners

Owners must have the right to offer the item; provide an item that matches its listing and is reasonably safe for the agreed use; disclose known defects, repairs, modifications, recalls and restrictions; maintain and inspect it appropriately; and provide guards, instructions and agreed protective equipment. An unsafe, damaged, recalled, or materially changed item must be removed until it is safe and lawful to offer again.

Owners remain responsible for pre-existing damage, ordinary wear, hidden or undisclosed defects, inadequate maintenance, missing safety components or instructions, and damage caused by permitted normal use.

Renters

Renters must be legally permitted and reasonably competent to use the item; inspect it at pickup; use it only for the agreed lawful purpose; follow instructions; use required protective equipment; protect it against loss and theft; and stop and report if it becomes unsafe, damaged, or abnormal.

A renter may be responsible for damage or loss caused by misuse, negligence, unauthorized use, ignoring instructions, inadequate custody, loss, theft, or non-return. Responsibility depends on evidence and applicable law; it is not presumed merely because damage was reported after the rental.

3. Licensing and eligible items

A listing's presence on MyJuhuu is not proof that an item or proposed use is lawful, insured, or suitable. A booking must not proceed when a required licence, certificate, registration, inspection, permit, age requirement, or other qualification is missing or invalid for the item, user, location, or intended use.

During Phase 1, the following may not be listed without an expressly launched, safety-reviewed category and required verification:

MyJuhuu may require enhanced condition records, serial numbers, proof of value, maintenance records, or user acknowledgements for powered tools, gas or flame appliances, event equipment, high-value electronics, and other controlled-risk items.

4. Handover and condition evidence

Both parties should document the complete item, accessories, existing wear or repairs, serial number where appropriate, safety components, protective equipment, basic operation when safe, and condition at return. Relevant evidence can include timestamped photographs, booking messages, receipts, maintenance records, estimates, and handover confirmations.

Missing photographs do not automatically decide responsibility, but weak or inconsistent evidence may prevent approval of a platform-managed claim.

5. Damage classifications

6. Claim reporting and review

  1. Notify the other party in the booking thread as soon as safely possible.
  2. An owner should normally open an item claim within 48 hours after return or scheduled return. A reasonably explained later report may still be considered.
  3. The owner identifies the loss and provides condition evidence, proof of value, and an estimate when reasonably available.
  4. The renter may accept, partially accept, or dispute the claim and submit evidence.
  5. Deposit movement may pause for a limited review. Nothing is deducted merely because a claim was submitted.
  6. MyJuhuu may request information, obtain an assessment, approve a platform-managed amount, reject unsupported portions, or refer the matter elsewhere.

Theft, deliberate damage, serious injury, or suspected crime should be reported to the appropriate authority when safe. MyJuhuu may request the report reference but does not require anyone to place themselves at risk to obtain evidence.

7. Valuing item damage or loss

A platform-managed claim uses reasonable direct economic loss: the lowest appropriate amount among reasonable repair cost, like-for-like replacement based on similar age and condition, or documented current value immediately before the event.

The calculation accounts for depreciation, prior condition, successful repairs, salvage, missing components, earlier payouts, and other recovery. It does not provide automatic new-for-old replacement, upgrades, sentimental value, unsupported estimates, penalties, or double recovery. Ordinary cleaning is not damage.

The security deposit is not automatically the claim amount, guaranteed recovery, or a limit on legal responsibility. It is not used to resolve bodily-injury or complex third-party liability claims through the ordinary item-damage workflow.

8. Injury and third-party property damage

Stop using the item, obtain emergency or medical assistance when needed, prevent further harm where safe, preserve evidence, and notify the other party and MyJuhuu.

MyJuhuu may preserve records and take safety action but does not determine or pay bodily-injury or third-party liability claims as an insurer in Phase 1. Parties should notify their own insurer promptly and obtain independent advice where appropriate.

9. MyJuhuu review, appeals, and legal rights

MyJuhuu may request evidence, pause payment movement, facilitate an agreement, classify a platform claim, restrict an item, or take account-safety action. MyJuhuu does not decide criminal responsibility or finally determine legal liability that only a court, authority, insurer, or binding settlement can determine.

Both parties receive a platform decision and an appeal route. A different reviewer should handle an appeal where practical. Good-faith reports are not penalized merely because they are not substantiated; false evidence and claim abuse may lead to restrictions.

Nothing in this policy excludes liability or rights that cannot lawfully be excluded. The version recorded with a booking governs MyJuhuu's process for that booking. A later insurance phase does not retroactively insure an earlier rental.
